Terms of Service

Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and Prosperity ("we", "us", "our"), operated from Madrid, Spain. By downloading, installing, or using the Prosperity mobile application (the "App") you confirm that you have read, understood, and agreed to these Terms.

If you do not agree, do not install or use the App. Continued use after material changes to these Terms constitutes acceptance of the updated Terms.

Description of Service

Prosperity is a personal performance application that tracks and analyses six domains: agenda, habits, nutrition, training, concentration, and system health. The App stores data locally on your device by default and offers optional cloud sync via Supabase, an optional AI assistant powered by third-party language models, and optional integrations with Google services.

Features may be added, modified, or removed at any time. We do not guarantee continuous, error-free operation.

Account Registration & Eligibility

Most features work without an account. Cloud sync, the AI assistant, and Google Calendar integration require a Supabase-backed account. You are responsible for keeping your credentials secure and for all activity under your account.

You must be at least 16 years old to use the App, in line with the Spanish implementation of GDPR (Article 8). If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Subscriptions & In-App Purchases

Prosperity offers a free tier and paid subscription tiers (Pro and Lifetime). All purchases are processed exclusively through Apple's App Store or Google Play, governed by their respective billing terms. We do not collect, process, or store your payment information.

  • Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before renewal.
  • Manage or cancel subscriptions in your Apple ID or Google Play account settings.
  • Lifetime purchases are one-time charges that grant access for as long as the App remains operational.
  • Free trials, if offered, automatically convert to a paid subscription unless cancelled before the trial ends.

Intellectual Property

The App, its source code, design, branding, copy, and all related assets are owned by Prosperity and protected by copyright, trademark, and other intellectual property laws. You receive a personal, non-transferable, non-exclusive, revocable licence to use the App in accordance with these Terms.

Data you create in the App (logs, habits, notes, photos) remains yours. You grant us a limited licence to process this data solely to operate the service you use, as further described in our Privacy Policy.

Prohibited Conduct

You agree not to:

  • Reverse-engineer, decompile, or extract source code from the App except where allowed by law.
  • Use the App to violate any law, infringe rights of others, or transmit harmful content.
  • Use automated systems to access the App in ways that strain our infrastructure.
  • Resell, redistribute, or commercially exploit the App or any of its features without permission.
  • Attempt to bypass billing, authentication, or rate-limiting mechanisms.

Disclaimers & Limitation of Liability

The App is not a medical device. Nutrition, training, and health-related metrics are informational only and are not medical advice, diagnosis, or treatment. Consult a qualified professional before making changes to your diet, training, or healthcare.

To the maximum extent permitted by law, the App is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages, including lost data, lost profits, or interrupted service. Nothing in these Terms limits liability for fraud, gross negligence, or rights that cannot be waived under Spanish or EU law.

Governing Law

These Terms are governed by the laws of the Kingdom of Spain. Any dispute is subject to the exclusive jurisdiction of the courts of Madrid, Spain, without prejudice to any consumer rights you have under mandatory law in your country of residence within the European Union.

Changes to Terms

We may update these Terms when the App or applicable law changes. We will notify you in-app for material changes at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
